Obtaining An FFL
Obtaining an FFL is a process that needs to be executed correctly the first time because that is really the only time the applicant has the law to their advantage. Yes, the 2ndAmendment requires the government to give you the right to bear arms, but that right has to be exercised within the boundaries of what the legislative process has come to dictate. What we mean is that the government has to respond to your FFL application within 60 days. No if’s, and or buts about it…they have 60 days to approve or deny your FFL application because that is what the standards/law say needs to be done. Now that you know that, lets see how the law really just crumbles when you make one little administrative error when filing your application, when attempting to obtain an FFL.
If you try to obtain your FFL and make a mistake of any type filing the paperwork, the door has just been opened to the bureaucratic quagmire that exists right inside the 2nd Amendment. What we are referring to is the fact that the ATF requirement to act quickly goes away once they have met the initial requirement of approving or denying your FFL application. If you make ANY mistake and the application is denied, you will then enter the appeals process and that process has no time limit to complete. The ATF itself will not tell you how long the appeals process will take, but you need to be warned that it will become a test of wills from that point on, since the law technically has been fulfilled by denying your application for obtaining an FFL.
What you need to understand here is that the government really wants to limit the quantity of FFL’s it allows to be issued. By creating a system that is hard to navigate, they have subverted the law because once they deny the FFL application, the process itself sort of falls into the legislative abyss. Since they have fulfilled the law by denying your FFL application within 60 days, the clock really has stopped ticking. That is why it is so important to file the FFL application correctly THE FIRST TIME when trying to obtain a FFL.
It is suggested that you use the services of either an attorney or an organization such as FFLKit because they have both the experience and the know how of how to submit your FFL application correctly the first time. Since you really only get one shot at the first time you apply…..don’t screw it up or you will more than likely end up giving up. Giving up is really what Uncle Sam wants you to do!
